Terms and Conditions

Please read these Terms and Conditions carefully before using the hive2.sharetribe.com website (the "service") operated by the bHive team.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the service.
By accessing or using the service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access this website.
Throughout this document we will refer to those who are renting out bees as “beekeepers” and those who are renting the bees as “farmers.”
The bHive marketplace is not responsible for the damage of any property as a result of misconduct from either party of a bee rental transaction. This includes, but is not limited to harm of bees, land, structures, crops, or hives. bHive is not responsible for any rules or regulations infringed upon by our customers. We act simply as a broker between parties who use our service and we are not responsible for their actions.
During all rental agreements, you must abide by the “Rules of Trade” listed below – unless otherwise agreed upon with a written contract. These rules can also be found under the “About” tab on our website.
1. Beekeepers are responsible for the transportation, maintenance, setup, removal, and cleaning of hives.
2. The general needs of the bees, such as water, food, or medication is the responsibility of the beekeeper. Water sources such as streams, irrigation, or ponds may be locally available on a seasonal basis.
3. Beekeepers may not leave their hives on the land of farmers before or after the rental period without the farmer’s consent.
4. Farmers are required to provide beekeepers a full disclosure of all pesticides and attractants that have been used on crops in the past 30 days within a two mile radius, to the best of their knowledge. However, farmers are not responsible for pesticide use on land out of their control.
5. Farmers must obtain permission of the beekeeper at least 48 hours before spraying any pesticides or attractants.
6. Farmers and beekeepers must abide by all city, county, state, and federal rules and regulations during rental transactions.
7. Both parties are liable to replace or repair damaged property that results from their misconduct.
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our service.
You are responsible for safeguarding the password that you use to access the service and for any activities or actions under your password, whether your password is with our service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Rights of Content
The users themselves retain the right to all text, pictures and other content that they create in the service. The users allow others to utilize the content in accordance with the nature of the service and furthermore allow the service provider to file information and data and make changes that are necessary for the service or the study. However, other rights are not transferred from the users, unless specifically otherwise agreed.
The responsibility of the content lies with the user, who has submitted it to the service. bHive has the right to remove any material when it deems it necessary.
The bHive logo and name are property of bHive and may not be used by third parties unless they acquire our permission. We have the right to refuse the use of our logo to anyone.
Links To Other Web Sites
Our Service may contain links to third-party web sites or services that are not owned nor controlled by bHive.
bHive has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that bHive shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease.
These Terms shall be governed and construed in accordance with the laws of California and the United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our service, and supersede and replace any prior agreements we might have between us regarding the service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the service.

Name of the register
User register of the bHive service
Use of personal details (purpose of register)
Personal details are collected to make communication and use of service possible. Details can be used for communication between service providers and users and also for direct communication between users. Some personal details are visible on the profile page of the user, but those details are voluntary (except name).
The handling of personal details is not outsourced, but the register data is stored on a server that is rented from a third party company.
Information content of the register
The following information may be stored in the register:
- Personal details: Name, email address, phone number, street address
- Account details: username, password (stored in encrypted format)
- The description text that the user may write about him/herself
- The offers and requests the user has posted to the service
- The given and received feedback and badges
- Statistical data about service usage, e.g. number times the user has logged in
Regular sources of information
Personal details are given by the user on registration to the service or when using it later.
Regular handovers of the information
Information considering users of a single bHive community may be handed over to the client who has founded that community or to the community administrators appointed by that client.
Transfers of the information outside the EU and the European Economic Area
Information may be stored to a server that may be located inside or outside of the EU and the European Economic Area
Register protection principles
The information is stored on computers. The access to the information is restricted with passwords and physical access to the computers is restricted by the server hosting company.
